Att. M. Buğra Çakır – Founding Partner

As a Founding Partner of Law and Trust Partners, I practise law in a way that covers the commercial risk management and strategic planning dimensions of legal advice. My honours degree from the Faculty of Law at the Turkish-German University, preceded by my business administration studies at Istanbul Bilgi University, allows me to approach legal matters not only from a statutory perspective but together with their operational and financial impact. With professional proficiency in Turkish, English and German, I manage the legal needs of domestic and foreign clients in Türkiye and in global markets. My command of procedure before national and international fora has led me to specialise in contract negotiations and the resolution of complex disputes.

I have focused my practice on the regulation of emerging technologies and commercial law. In my technology law practice, I personally structure the legal framework that technology companies need for investment and exit, from the source code ownership of software projects to licensing models, and from drafting SaaS (Software as a Service) agreements to preparing Employee Stock Option Plans (ESOP).

In financial technology, I run licensing processes for Crypto Asset Service Providers (CASPs), ensure that tokenisation projects comply with Capital Markets Board regulations, and negotiate "Launchpad" agreements for financing Web3 projects. I integrate the blockchain integration of Real World Assets (RWA) and the obligations of the EU Artificial Intelligence Act (AI Act) directly into company policies within the framework of algorithmic transparency, data governance and copyright liability.

In corporate law, I personally handle mergers and acquisitions (M&A) and the establishment of offshore companies and foundations suited to cross-border tax planning. Through the due diligence reports and Shareholders' Agreements (SHA) I prepare in investment processes, I minimise risks in company management. My core aim at Law and Trust Partners is not merely to bring the client's commercial operations into line with current legislation, but to manage future legal and financial risks according to the principle of preventive law.

In corporate law, we handle company formations, mergers and acquisitions (M&A), Shareholders' Agreements (SHA) and legal due diligence for investment processes, making risks in corporate governance foreseeable and manageable. For businesses in financial difficulty, we provide comprehensive support under concordat (restructuring) and bankruptcy law, covering debt restructuring strategies, creditor negotiations and the protection of rights and receivables in insolvency proceedings.

Tax law is at the heart of our service model. We identify the tax exemptions, grant programmes and government incentives that suit our clients' fields of activity and ensure they benefit from them effectively, and we represent our clients robustly in tax disputes.
