The Climate Law and Administrative Obligations

In this context, the first task is to manage the new administrative and technical obligations that the Climate Law imposes on legal entities in key sectors such as industry, energy, transport, agriculture and construction. Following proceedings before the Climate Change Directorate within the Ministry of Environment, Urbanisation and Climate Change and other relevant regulators is vital.

Emissions Trading System (ETS)

The Emissions Trading System (ETS), a market-based mechanism for buying and selling carbon emission allowances that the Law has integrated into the Turkish legal system, has also created a new field of legal expertise. We carefully handle businesses' representation before the Carbon Market Board and Energy Markets Operation Inc. (EPİAŞ), and the process of obtaining and managing the mandatory "Greenhouse Gas Emission Permit".

Carbon Border Adjustment Mechanism (CBAM)

Alongside national regulations, the European Union's Carbon Border Adjustment Mechanism (CBAM) has the potential to create trade barriers for export-oriented companies. Our firm provides strategic advice to clients in carbon-intensive sectors, in particular iron and steel, cement, aluminium and fertilisers, to help them comply with international trade law norms and obligations.

Reporting (MRV) and Sanctions

Another critical aspect of the Law is the monitoring, reporting and verification (MRV) obligations based on transparency and accuracy. Failure to submit verified emission reports on time, false declarations or breaches of database notification obligations can lead to severe sanctions under the Law, including administrative fines of up to 50 million Turkish lira and the suspension of business operations. Our firm represents clients in administrative inspections and provides legal protection by bringing objections and annulment actions against possible sanctions and by setting up in-house control mechanisms.
