Telemedicine, mobile health (mHealth) solutions and AI systems used in healthcare are fundamentally changing the way healthcare is delivered. Under the applicable legislation, above all the Regulation on the Remote Provision of Healthcare Services, we structure platforms' permit and authorisation processes, the contractual relationship between physicians and platforms, and user agreements on behalf of our clients.

Under Personal Data Protection Law No. 6698 (KVKK), health data are special categories of personal data subject to the strictest protection regime. For hospitals, clinics, laboratories, insurers and health-tech start-ups, we provide legal support in preparing data processing inventories, privacy notices and explicit consent texts, cross-border data transfers, data security measures and proceedings before the Personal Data Protection Board.

Placing medicines, medical devices and cosmetic products on the market requires a multi-layered authorisation and conformity process supervised by the Turkish Medicines and Medical Devices Agency (TITCK). We advise on obligations under the Medical Device Regulation, which is aligned with European Union law, on marketing authorisation and registration, on restrictions on promotion and advertising, and on supply and distribution agreements.

We represent private hospitals, medical centres, polyclinics and private practices in their establishment, licensing and operating permit processes and in Ministry of Health inspections. Our work in this area also covers health tourism authorisation certificates, relationships with intermediary agencies, contracts with healthcare staff, and objections and annulment actions against administrative sanctions.

In disputes arising from medical interventions, the physician's duty of care, the patient's informed consent and the liability of the healthcare institution are decisive. We provide legal representation in patient rights violations, compensation claims and compulsory professional liability insurance matters, from pre-litigation risk assessment through mediation to court proceedings.
